Libération de Guy-Hervé Kam au Burkina Faso

L’avocat burkinabè Guy Hervé Kam était détenu depuis maintenant plus d’un mois à la Direction générale de la sûreté de l’Etat, à Ouagadougou. Il est accusé d’atteinte à la sûreté de l’Etat. Le Tribunal administratif de Ougadougou, au Burkina Faso, a ordonné aujourd’hui sa « libération immédiate ».

Le collectif d’avocats qui assure sa défense a jugé sa détention illégale et rappelé qu’aucune loi au Burkina Faso ne permet de garder un suspect au-delà de cinq jours, pour des cas d’atteintes à la sûreté de l’Etat, et de 25 jours pour des cas de terrorisme et de crimes économiques et financiers.

42 jours à la Sûreté

L’avocat Guy Hervé Kam devrait immédiatement retrouver sa liberté à l’issue de la décision du juge. Après avoir passé 42 jours à la Direction générale de la sûreté de l’Etat, Guy Hervé Kam a bénéficié du respect de ses droits.

Selon Prosper Farama, avocat de la défense de Guy Hervé Kam, l’Etat burkinabè devrait désormais garantir la liberté de son client :

« Ce que le tribunal a déclaré, c’est en somme que l’Etat du Burkina Faso devrait immédiatement remettre en liberté maître Kam Guy Hervé et prendre toutes les dispositions pour que’il ne soit plus privé de sa liberté. Nous espérons que dans un esprit de construction de l’Etat de droit, de l’Etat démocratique, l’Etat lui-même en tirera la leçon et la conséquence des décisions judiciaires qui sont rendues. Notre entendement, c’est de tracer les sillons de l’Etat de droit que nous voulons construire ensemble. »

Des mois d’arrestations arbitraires

Cette décision redonne espoir aux garants du respect des libertés individuelles au Burkina Faso, alors que ces derniers mois ont été marqués par de nombreux cas d’arrestations arbitraires et d’enrôlements forcés dans les forces armées.

Yoporeka Somet est secrétaire national chargé du panafricanisme et des diasporas du mouvement Sens. Il salue la décision du juge en ces termes :

« C’est une très grande joie. Nous sommes très heureux que cette décision ait été rendue par le Tribunal administratif. Nous avons toujours fait confiance à la justice de notre pays et nous avons toujours voulu demander, et c’était le combat de maitre Kam, que plus de moyens soient donnés à la justice pour qu’elle puisse faire son travail en toute sérénité. Nous nous préparons à accueillir maître Guy Hervé Kam et à célébrer son retour à la liberté avec nous. »

Délai pour faire appel

Guy Hervé Kam est poursuivi pour « atteinte à la sûreté de l’Etat à travers la mobilisation d’étudiants et de notables coutumiers », selon l’Etat burkinabè. Celui-ci a un délai de deux semaines pour faire appel.

Rappelons que le collectif d’avocats avait démontré, lors des audiences, le non-respect du droit de maitre Guy Hervé Kam en révélant qu’aucune poursuite pénale n’était engagée contre celui-ci.

Le 5 mars dernier, le collectif d’avocats avait ainsi demandé sa libération et le respect de ses droits.

Mais la question est de savoir si les autorités militaires à la tête de l’Etat vont respecter cette décision judiciaire.

En effet, le même tribunal administratif avait déjà ordonné la suspension des enrôlements forcés contre les journalistes Issaka Lingani, Rasmané Zinaba et Bassiroun Badjo, mais les autorités ont ignoré l’avis du juge et ces derniers ont été tout de même réquisitionnés.
